- Employee and workforce data is collected lawfully
6. Workforce and Attendance Records
Tympo provides tools for attendance tracking, workforce management, reporting, and related operational functions.
Customers are solely responsible for:
- Attendance policies
- Payroll calculations
- Employment decisions
- Regulatory compliance
- Human resource decisions
Tympo does not provide legal, payroll, tax, employment, or compliance advice.
7. AI and Automated Features
Certain features may utilize artificial intelligence, machine learning, OCR, or automated processing technologies.
While we strive for accuracy, AI-generated outputs may contain errors or inaccuracies.
Customers should independently review and verify any automated outputs before relying on them for business, legal, payroll, employment, or compliance purposes.
Tympo is not responsible for decisions made based solely on automated outputs.
8. Subscription Plans and Billing
Certain features may require a paid subscription.
By subscribing, you agree to pay all applicable fees.
Unless otherwise stated:
- Fees are charged in advance
- Subscription fees are non-refundable
- Taxes may be added where required by law
- Pricing may change upon reasonable notice
Failure to pay may result in suspension or termination of access.
9. Free Trials and Promotional Offers
We may offer free trials or promotional access.
We reserve the right to:
- Modify or terminate promotions
- Limit eligibility
- Suspend accounts abusing promotional offers

Confidential information does not include information that:

- Was lawfully known before disclosure
- Is independently developed
- Is lawfully obtained from a third party
12. Availability and Service Changes
We strive to maintain reliable service but do not guarantee uninterrupted availability.
We may:

- Add or remove functionality
- Perform maintenance
- Suspend access when necessary
without liability.
13. Third-Party Services

Tympo is not responsible for third-party services.
14. Suspension and Termination

Customers may discontinue use of the Service at any time.
Termination does not relieve obligations accrued before termination.
15. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TYMPO DISCLAIMS ALL WARRANTIES, INCLUDING:
- MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- ACCURACY
- RELIABILITY
- AVAILABILITY
We do not warrant that the Service will be uninterrupted, secure, or error-free.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TYMPO SHALL NOT BE LIABLE FOR:
- INDIRECT DAMAGES
- INCIDENTAL DAMAGES
- CONSEQUENTIAL DAMAGES
- SPECIAL DAMAGES
- LOSS OF PROFITS
- LOSS OF REVENUE
- LOSS OF DATA
- BUSINESS INTERRUPTION
In no event shall Tympo's total liability arising out of or relating to the Service exceed the total amount paid by the Customer to Tympo during the twelve (12) months preceding the claim.
If the Customer has not paid any fees, Tympo's total liability shall not exceed USD $100.
17. Indemnification
You agree to defend, indemnify, and hold harmless Tympo, its affiliates, officers, employees, and agents from any claims, damages, liabilities, losses, and expenses arising from:
- Your use of the Service
- Your Content
- Your violation of these Terms
- Your violation of applicable laws or third-party rights
18. Force Majeure
Tympo shall not be liable for delays or failures caused by events beyond reasonable control, including:
- Natural disasters
- Power outages
- Internet disruptions
- Government actions
- Labor disputes
- Cybersecurity incidents
- Failures of third-party infrastructure
19. Governing Law
These Terms shall be governed by and construed in accordance with the laws applicable in the jurisdiction in which Tympo operates, without regard to conflict of law principles.
Any dispute arising under these Terms shall be resolved in the courts having jurisdiction over such matters.
20. Changes to These Terms
We may update these Terms from time to time.
Updated versions will be posted on the Service with a revised Effective Date.
Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
